Debt Settlement Agreements
Some debtors from who we are trying to collect debts may request and receive, through the payment portal on this Website and/or through or with the assistance of one of our Customer Service Representatives, compromises in the amounts and/or terms of repayment. These additional terms and conditions are made part of all such compromise agreements, and incorporated in all such compromise agreement by reference as stated on our payment portal webpage. If you default in payment and/or other performance of such a compromise agreement, we shall be entitled to : (1) declare the compromise agreement null and void and proceed to collect the underlying debt according to the terms of the original loan agreement, giving you credit for all amounts previously paid; and/or, (2) sue on the compromise agreement itself and recover the remaining balance, court costs and reasonable attorney fees plus interest from the charge-off date set forth in our debt validation notice, which is incorporated herein by this reference, at the rate of the lesser of: (i) the rate stated in the original loan agreement; (ii) 36% per annum; or, (iii) the highest rate permitted by law.
Governing Law
These Terms of Use are governed by the laws of the State of Ohio without regard to its conflict of laws principles.
If the bar rules in your jurisdiction require CA/USA to identify an attorney responsible for this Website, CA/USA designates Dean S. Hoover, whose may be contacted using the Contact Us form as the responsible attorney for this purpose.
